Michael Vincent Gidney In Custody (Update 2)

Incarcerated at Central Detention Center

Update 2 - Thursday 5:40 a.m.

San Bernardino, CA - Michael Vincent Gidney, 31, wanted on a no bail warrant, remains incarcerated at the Central Detention Center (CDC) in San Bernardino after surrendering to Sheriff's deputies.

An apparent keypunch error in the Sheriff's Booking Log that is updated daily, means the listing of all bookings in the county jail system does not show Gidney's surrender to authorities at 10:18 p.m. Tuesday night.

RIMOFTHEWORLD.net readers alerted the news department that Gidney had turned himself in and it was confirmed by the Twin Peaks Station late yesterday afternoon.

San Bernardino, CA – The San Bernardino County Sheriff's Department has confirmed that Michael Vincent Gidney, 31, has surrendered to deputies at the Central Station in San Bernardino.

Gidney, who was wanted on a no bail warrant and a $40,000 warrant, turned himself in late last night and was booked at the Central Detention Center at 10:18 p.m.

A Sheriff's Department spokesperson told RIMOFTHEWORLD.net Gidney was booked on the two outstanding warrants. One warrant related to a charge of battery and failure to turn himself in at the Glen Helen Rehabilitation Center. The second warrant was issued after he failed to appear at a domestic violence probation review hearing.

Twin Peaks, CA – The Twin Peaks Sheriff's Station is seeking the public's assistance in locating Michael Vincent Gidney, 31, who may be hiding out in the San Bernardino Mountains. He is wanted on a no bail warrant related to a conviction on a charge of battery.

On May 14, a notice of failure to appear for jail time was filed and a bench warrant was sent to Judge Donna Gunnell Garza who signed the order on May 18. The warrant was delivered to the Sheriff's Department on May 19.

On March 3, Judge Michael Knish accepted a plea bargain to a charge of battery on January 2, 2009 and ordered a count of obstruction of justice dismissed. Gidney was placed on probation for 36 months and sentenced to serve 90 days in a county jail, with credit for 10 days served. He was ordered to report to the Glen Helen Rehabilitation Center by 3 p.m. on March 27.

The failure to comply with the order to report to Glen Helen led to the bench warrant for Gidney. The original warrant was for $40,000 and court ordered it couldn't be forfeited because the suspect, according to court documents, had allegedly violated terms of his probation and was listed as a fugitive.

In addition, Gidney was scheduled to serve a 90 days sentence on a March 3 nolo contender plea to a count of inflicting corporal injury on a spouse/cohabitant and willful cruelty to a child. He failed to appear for a April 30 domestic violence probation review hearing.

At that time, Judge Michael Dest issued the no-bail warrant and ordered probation revoked. The reason for the revocation was failure to appear on a court order.
